These terms are an agreement between you and EZ Software Labs LLC, a Texas limited liability company ("we", "us"), for the EZHomePing app, our account page on the web, and the service behind them ("EZHomePing"). By creating an account or using EZHomePing you agree to them, and to our privacy policy, which says what we do with your information.
Please read three parts of them with care. EZHomePing is not an emergency service: in an emergency, call 911 (section 3). What we promise, and what we are responsible for, is limited (sections 13 and 14). And section 17 has disagreements between us decided by an arbitrator, one person at a time — not by a judge or a jury, and not in a class action — unless you opt out within 30 days.
1. What EZHomePing is
Location sharing within circles of people who choose each other. Your phone encrypts your location before it leaves the phone, so that only the phones in your circles can read it. We run the service, but it is built so that we cannot see where anyone is.
2. What EZHomePing is not
- Not an emergency service. EZHomePing does not call 911, or anyone, for you. In an emergency, call 911 yourself. See section 3.
- Not always current, and not always right. Locations and alerts arrive as well as phones and networks allow, and can be late, missing or wrong. See section 4.
- Not a way to keep anyone safe. Nobody should rely on EZHomePing to protect anyone, or to make a decision where a late, missing or wrong location or alert could hurt someone.
- Not a witness. Its drives, alerts and scores are for you and the people you choose, not for insurers, employers, the police or a court. See section 5.
- Not insurance. What you pay is for a service, not for anyone's safety or property. See section 14.
- Not for watching anyone without their knowledge. See section 7.
3. Emergencies: SOS and alerts
EZHomePing does not contact 911, the police, an ambulance, the fire service, a monitoring centre or anyone else outside your circles, and nobody at EZ Software Labs watches for alerts or answers them: we cannot read them. An SOS, a possible-crash alert, a low-battery alert, an alert that someone arrived at or left a place, a drive's alert and a request for someone's location go only to people in your circles, and only as their phones and the networks between us deliver them.
In an emergency, call 911 — or the local emergency number — yourself, or have someone with you call. Do not wait for anyone in your circle to see an alert, or to answer one. Where the app offers to call 911, it opens your phone's dialler with the number filled in: you make the call, and EZHomePing tells emergency services nothing, where you are included.
Alerts can be late, missing, wrong or false. Any alert can fail to arrive: a phone switched off, out of signal or out of battery; notifications or the app silenced, restricted or turned off; a push service delayed; our servers down. The person who should see it may be asleep or busy. The people in your circles are not trained responders, and may not be able, or near enough, to help. Anyone who receives an alert and believes someone may be in danger should call 911.
Crash detection works only while it is turned on, on a phone in a moving car, after the phone has seen a driving speed. It can take something else for a crash — a dropped phone, a pothole, a jolt — and it can miss a real one: a slow crash, a phone thrown clear or switched off, an app the phone's system has stopped. If you do not answer "Are you OK?" within about a minute, the adults in your circles are told where you are, even while your sharing is paused. Low-battery alerts and alerts about places and drives are worked out by phones, from what each phone senses and what its system allows, and the same limits apply.
Do not rely on EZHomePing to know that someone is safe, to protect anyone, or for any decision about health, safety or security where a late, missing or wrong location or alert could cause harm.
4. Locations and alerts are best effort
A location, and every alert, depends on things neither we nor you fully control: the phone and its system; the permissions and settings on it — location "always", background activity, battery saving, notifications, Focus or Do Not Disturb; its battery; its GPS, Wi-Fi and mobile signal; the networks and push services between phones; the app stores' and phone makers' rules for apps in the background; our servers; and the choices of the people in your circles, who can pause, share approximately or turn alerts off. Any of them can make a location inaccurate — sometimes by a long way — out of date or missing, and an alert late or never sent. The app shows how old each location is: check it. A location is where a phone was, which is not always where its owner is.
We may change, pause or stop any feature, and EZHomePing may be unavailable at times — for maintenance, an outage, or a reason outside our control. A test version — a beta, a preview or a TestFlight build — may be incomplete, and can change or stop at any time.
5. Driving features
Crash detection is on every plan. On Max, EZHomePing also records drives: each drive's route, speeds and hard brakes, speeding against posted limits, phone handling, a score, and alerts at a drive's end.
- They are information, not fact. They are worked out by a phone's sensors and its system, and can be wrong, or miss something that happened. A hard brake may be a pothole; a drive may be a passenger's.
- Speed limits come from OpenStreetMap, a map made by volunteers. A limit can be missing, wrong, out of date or another road's, and temporary, school-zone and work-zone limits are often missing. Where EZHomePing does not know a limit it claims no speeding, but a limit it does show can still be wrong. The posted limit is the one that counts.
- Phone handling is what the phone reports — that it was unlocked while the car moved. It cannot tell who held it, or whether it was used hands-free.
- A score is our own formula, which we may change. It does not measure how safe a driver is.
- Not evidence. Drives, alerts and scores are not evidence of fault, of speed or of what happened, and we cannot read them or vouch for them. They are not made for insurance, employment, credit, housing or legal decisions about anyone, or as proof in a claim or in court, and must not be used for them; anyone who uses them that way does so at their own risk.
- Never use EZHomePing while you drive. Set it up before you set off, and let a passenger handle it. Nothing in EZHomePing makes it safe, or lawful, to look at a phone while driving. Obey the law and the road's signs.
6. Your account
You must be 18 or older to use EZHomePing on your own. From 13, a teenager can have their own account, linked to a parent or guardian who agrees to these terms for them; the guardian is responsible for the teenager's use until they turn 18. A teenager cannot own a circle or buy a plan.
You need an email address you can receive codes at. A phone number is optional, though we may ask you to confirm one when many accounts are being made at once. Give us a true birth month and year: it decides who may use EZHomePing, and it cannot be changed in the app. You are responsible for your phones, and for what is done with your account on them: remove one you lose, in the app or on the web. One account is for one person.
7. Consent, and using EZHomePing lawfully
EZHomePing works only between people who know about it and agree to it. So:
- Share only your own location, from a phone you carry and use yourself.
- Invite only people who know what EZHomePing does and agree to join. Everyone in a circle can see who is in it, and anyone can pause their sharing or leave a circle at any time.
- Never track anyone without their knowledge and agreement, or where a court order forbids it — a partner or former partner, a relative, a friend, an employee or anyone else. Do not put EZHomePing on a phone someone else carries, or sign in to your account on one; do not give someone a phone with EZHomePing on it without telling them; and do not use someone else's phone or account to watch them. In many states, Texas among them, tracking someone's phone or car without their consent can be a crime.
- Never use EZHomePing to harass, threaten, stalk, intimidate, coerce or control anyone, or to find someone who does not want to be found.
- EZHomePing is for personal use among family and friends: not for monitoring employees, contractors, customers or vehicles for a business, and not for providing a service to others.
- Do not pretend to be someone else or give a false age; get around anyone's pause, precision or privacy settings, or the rules for who may use EZHomePing; interfere with, probe, overload, scrape or attack the service, or try to reach data that is not yours; resell EZHomePing; or use it for anything unlawful.
You are responsible for using EZHomePing lawfully. The laws on tracking, privacy, recording, stalking, family matters and employment are yours to follow, and they differ from state to state.
If you are worried that someone is tracking you, you can pause your sharing, leave every circle at once, and remove phones you do not recognize, in the app. Report misuse from the app, or at support@ezsoftwarelabs.com. If you are in danger, call 911.
We may look into a report, but we do not have to. We may suspend or close an account we believe breaks this section — at once, and without notice, where someone's safety may be at risk — and keep what we need of it, and disclose it to the authorities, as the law allows and our privacy policy and law-enforcement guidelines describe.
8. Plans and payment
EZHomePing has a free plan and paid plans — Plus, Pro and Max — sold by the month or the year through Google Play or the App Store. The store takes the payment and its terms apply to it; the price, and any tax, is shown in the store before you buy. A plan renews by itself, for the same period, until you cancel it in the store's subscription settings, which you can do at any time; to stop the next renewal, cancel at least 24 hours before the period ends. A cancelled plan lasts to the end of the period paid for. Refunds are the store's to give, under its rules; we do not give them ourselves, except where the law requires it. A plan covers every circle its payer owns. Deleting your EZHomePing account does not cancel a store subscription. When a plan ends or moves to a smaller one, history older than the new plan keeps is deleted within a day of the change being final, and cannot be brought back.
We may change what a plan includes or costs. A change to the price of a plan you have takes effect only at a renewal, after the store has told you about it. Free access to a paid plan that we give — to testers, or in an offer — can end when its time ends, or when we end it.
9. Your content, and our software
Your locations, places, notes and circle names are yours. You let us store them and pass them on, encrypted, only to run EZHomePing for you and your circles. We cannot read them.
The app, the website and the service are ours, or licensed to us. We give you a personal, non-exclusive, non-transferable licence, which we may end under section 12, to use the app on phones you own or control, and the service, under these terms. You may not copy, change, sell or take apart the app, except as the law, or an open-source licence for a part of it, allows. The app includes open-source software and map data under their own licences, listed in the app. If you send us an idea or feedback, we may use it freely, owing you nothing for it.
10. Other companies' services
EZHomePing relies on other companies' services: the App Store and Google Play; Apple's and Google's systems, location services and push services; the map and address services your phone asks directly — OpenFreeMap and OpenStreetMap, Apple Maps, and Google's and Apple's address lookups; the companies that send our email and texts; Google Cloud, where our servers run; and your own mobile carrier and internet provider. Maps, road names, addresses and speed limits come from OpenStreetMap's volunteer contributors and others, and can be wrong or out of date.
We do not control these services and are not responsible for them, for what they provide, or for their being unavailable. Their own terms and privacy policies apply when you use them, and you must follow them — your carrier's, and its charges for data and texts, included. A link to another company's site is not our endorsement of it.
11. Security, and your recovery phrase
We protect EZHomePing as our privacy policy describes, but no system is perfectly secure, and we cannot promise that nobody will ever reach what we hold, or what passes through our servers, without the right to. End-to-end encryption protects the contents of what you share — locations, places, alerts, drives and circle names — not the facts around them, which our servers can read and our privacy policy lists: your account, your phones, who is in which circle, when your phones connect, and the kind of an alert and when it was sent.
Anyone who can use your unlocked phone, or a phone in one of your circles, can see what that phone sees. Keep your phones locked and up to date, remove one you lose, and keep your recovery phrase where only you can find it. We never have your phrase, and cannot reset or recover it: if you lose it and every phone signed in to your account, your history cannot be read again, by you or by us. Someone who has your phrase can ask to add a phone to your account; EZHomePing is designed to wait a day and to tell your other phones and your email address first, so that you can stop it — so do not ignore those warnings.
If we learn of a breach of security that affects your personal information, we will tell you, and the authorities, as the law requires.
12. Ending
You can leave any circle, or every circle, at any time, and delete your account in the app or on the web.
We may suspend or close your account, or end your use of any part of EZHomePing: at once, for a serious breach of section 7, where someone's safety or the security of the service is at risk, or where the law requires it; for any other breach of these terms; or for any other reason, with reasonable notice. We may stop offering EZHomePing altogether: if we do, we will post a notice on our website at least 30 days before, saying how to get a copy of your data, and we will try to tell you by email as well. When an account is closed, what it held is deleted as our retention schedule says.
Sections 2 to 5, 9 (apart from the licence it gives you), 10, 11 and 13 to 20 continue after your account or these terms end.
13. What we promise, and what we do not
Put simply: we offer EZHomePing as it is, and make no promise about it beyond what these terms say. The law asks a disclaimer like this to stand out, so here it is in full.
EZHOMEPING IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL ITS FAULTS. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM EVERY WARRANTY AND CONDITION, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR A USAGE OF TRADE. WE DO NOT WARRANT THAT EZHOMEPING, OR ANY LOCATION, ALERT, SOS, CRASH DETECTION, SPEED LIMIT, DRIVE OR SCORE, WILL BE ACCURATE, COMPLETE, TIMELY, DELIVERED, SECURE, UNINTERRUPTED OR FREE OF ERRORS, OR THAT EZHOMEPING WILL DETECT ANY CRASH OR EMERGENCY. NO ADVICE OR INFORMATION FROM US, IN THE APP, ON OUR WEBSITE OR ELSEWHERE, CREATES A WARRANTY THAT THESE TERMS DO NOT STATE.
Some states do not allow implied warranties to be disclaimed. Where yours does not, they last only as long as the law requires.
14. Our responsibility to you
Put simply: we are not an insurer, and if something goes wrong, what we owe you is limited. Again, the law asks this to stand out.
We are not an insurer. What you pay is for a service. It has nothing to do with the value of anyone's life, health or property, or with the losses a late, missing or wrong location or alert could cause; it would have to be far higher if we were to bear them. Insuring people and property is yours to arrange.
TO THE FULLEST EXTENT THE LAW ALLOWS:
(A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR EZHOMEPING.
(B) WE ARE NOT LIABLE FOR ANY LOSS, INJURY OR DEATH THAT RESULTS FROM: A LOCATION, ALERT, SOS, CRASH DETECTION, SPEED LIMIT, DRIVE OR SCORE THAT WAS LATE, MISSING, INACCURATE OR FALSE; EZHOMEPING, OR A PART OF IT, BEING UNAVAILABLE; WHAT ANYONE ELSE DOES WITH EZHOMEPING OR WITH WHAT YOU SHARE WITH THEM; OR ANYONE ACTING, OR NOT ACTING, ON WHAT EZHOMEPING SHOWED OR DID NOT SHOW.
(C) IF, DESPITE (A) AND (B), WE ARE FOUND LIABLE TO YOU, OUR TOTAL LIABILITY FOR EVERY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR EZHOMEPING, TOGETHER, IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR EZHOMEPING IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE FIRST CLAIM, AND US$100.
(D) THESE LIMITS APPLY TO EVERY CLAIM, WHETHER IT RESTS ON CONTRACT, WARRANTY, TORT — INCLUDING OUR OWN NEGLIGENCE — STRICT LIABILITY, STATUTE OR ANY OTHER THEORY; EVEN IF WE WERE TOLD THE LOSS WAS POSSIBLE; AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY PROTECT OUR MEMBERS, MANAGERS, EMPLOYEES AND CONTRACTORS AS THEY PROTECT US.
(E) NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY FOR OUR GROSS NEGLIGENCE, FRAUD OR WILFUL MISCONDUCT, OR ANY LIABILITY THE LAW DOES NOT ALLOW TO BE LIMITED OR EXCLUDED.
Some states do not allow some of these limits — on incidental or consequential damages, or on liability for injury, for example. Where yours does not, they apply to you only as far as its law allows, and you may have other rights. If you live in New Jersey, sections 13 and 14 apply to you only as far as New Jersey law allows, and nothing in them limits a right you have under the New Jersey Consumer Fraud Act or New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act. Nothing in these terms limits a right you have under the Texas Deceptive Trade Practices–Consumer Protection Act, or under another consumer-protection law, that the law does not let you give up. These limits are part of the bargain between us: without them, we could not offer EZHomePing free, or at its prices.
15. If someone claims against us because of what you did
You will indemnify and hold harmless EZ Software Labs LLC, and its members, managers, employees and contractors, against any claim made by someone else, and the losses, fines, costs and reasonable lawyers' fees that come with it, to the extent it arises from: your using EZHomePing to locate, follow or watch anyone without their knowing agreement, or anything else section 7 forbids; your breach of these terms; your breaking a law, or someone else's rights; or anything you share through EZHomePing. This does not cover a claim as far as our own negligence or misconduct caused it. We will tell you of such a claim, may take over its defence, and you will help us with it; you may not settle it without our agreement.
16. Disagreements
Tell us first. Most problems are solved by an email to support@ezsoftwarelabs.com. Before a claim, section 17.3 asks for a notice and 60 days to settle it.
Law. These terms, and every disagreement between us, are governed by the laws of the State of Texas, apart from its rules on which law applies, and section 17 by the Federal Arbitration Act. If you live in another state, the protections of its consumer laws that cannot be given up still apply to you.
Courts. A claim that is not arbitrated — because section 17 leaves it out, you opted out of it, or a court decides it cannot be — goes to the state or federal courts in Fort Bend County, Texas, and you and we agree to their jurisdiction, unless the law where you live requires otherwise. Either of us may instead bring an individual claim in a small-claims court where it qualifies, the one where you live included.
Two years and a day. A claim arising out of or relating to these terms or EZHomePing must be brought — in arbitration, or in court where these terms allow it — no later than two years and one day after it accrues, unless the law that applies requires a longer period; after that, it is barred.
17. Arbitration, and no class actions
PLEASE READ THIS SECTION WITH CARE: IT AFFECTS YOUR RIGHTS. UNLESS YOU OPT OUT UNDER 17.8, YOU AND WE AGREE THAT DISAGREEMENTS BETWEEN US WILL BE DECIDED BY AN ARBITRATOR, ONE CLAIMANT AT A TIME — NOT BY A JUDGE OR A JURY, AND NOT IN A CLASS ACTION.
17.1 What it covers. Every dispute, claim or controversy between you and us that arises out of or relates to these terms, EZHomePing, our privacy policy, or anything we did or did not do — whether it rests on contract, tort (negligence included), statute, fraud or anything else — except those in 17.2. These terms involve interstate commerce, and the Federal Arbitration Act (9 U.S.C. §1 and following) governs this section, not the Texas Arbitration Act.
17.2 What it leaves out. (a) Either of us may bring an individual claim in a small-claims court, for as long as it stays there. (b) Either of us may ask a court to stop the infringement or misuse of intellectual property, or someone breaking into, overloading or misusing the service. (c) A claim for public injunctive relief, where the law that applies does not let it be given up, goes to court once the individual claims have been arbitrated, and waits for them.
17.3 A notice, and 60 days, first. Before either of us starts an arbitration or a small-claims case, the one with the claim sends a notice of dispute: you to support@ezsoftwarelabs.com, with "Notice of dispute" in the subject; we to your account's email address. It gives your name and your account's email address, what the dispute is about, and what you want. Each notice is one person's, about their own claim, and comes from them — a lawyer may help. Then we have 60 days to settle it, and either of us may ask to talk it over, by phone or video, in that time, with you taking part yourself, with a lawyer if you like. The time limit in section 16 stops running from the notice until the 60 days end. An arbitrator or a court may pause a case started without this step until it has been taken.
17.4 The arbitration. If the dispute is not settled, either of us may start an arbitration with the American Arbitration Association (AAA), under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, as they stand when it starts (adr.org). If the AAA will not hear it, it goes to JAMS, under its rules and its Consumer Arbitration Minimum Standards; and if neither will, a court appoints the arbitrator. One arbitrator decides it, by video, phone or written submissions, or in person in the county where you live, as the rules provide. The arbitrator follows the law, and may award you any individual relief a court could — lawyers' fees and costs included, where the law allows them — but only to you, and only as far as your own claim needs. The arbitrator decides whether a dispute must be arbitrated, except that a court decides any question about 17.2(c), 17.6, 17.7 or 17.10. The award is final, and any court with jurisdiction may enter judgment on it.
17.5 Fees. The AAA's rules decide who pays its fees and the arbitrator's. Under its consumer rules, you pay only the consumer's filing fee, and we pay the rest, unless those rules let the arbitrator decide otherwise — for a claim found frivolous, for example. Each of us pays our own lawyers, unless the law, or the arbitrator under it, says otherwise.
17.6 One person at a time. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY, AND NOT AS A PLAINTIFF OR A CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. Unless both of us agree, an arbitrator may not join or consolidate more than one person's claims, apart from what 17.7 provides, or preside over any class or representative proceeding.
17.7 Many claims at once. If 25 or more notices of dispute or demands for arbitration raising similar claims are sent or filed by, or with the help of, the same or coordinated lawyers or organizations, they are a mass filing, and this paragraph applies to them as well as the AAA's Mass Arbitration Supplementary Rules. The lawyers on each side first meet to discuss them. Then each side chooses up to 10 of them, and those 20 go ahead first, each before a different arbitrator and each decided on its own, binding only its own parties; the rest are not filed, or are held, and no fees are due on them. Once the 20 are decided, the rest go to a single mediation, whose mediator we pay. If the mediation does not settle a claim within 90 days of its first session, the claim is no longer arbitrated: it may go to court under section 16, individually or, despite 17.6, joined with other claimants who took these steps — never as a class — and 17.11 applies to it. The time limit in section 16 stops running for every claim held back, from its notice of dispute until it may go ahead. A court decides any dispute about this paragraph, and may enforce it.
17.8 Opting out. You may opt out of this section by an email to support@ezsoftwarelabs.com, from your account's email address, with "Arbitration opt-out" in the subject and your name in it, within 30 days after you first agree to terms that include it. Opting out changes only this section, and only for you: the rest of these terms still apply, section 16 included. We will reply to confirm it.
17.9 If part of it fails. If the waiver in 17.6 cannot be enforced against a claim, that claim — and only that claim — goes to court under section 16, and waits there until the individual claims have been arbitrated; it is never arbitrated as a class. If any other part of this section cannot be enforced, it is removed, and the rest still applies.
17.10 Changes to this section. A change we make to this section takes effect 30 days after we post it, applies to both of us alike, and never applies to a claim that arose, or that either of us had notice of, before it took effect. You may also reject the change within those 30 days, by an email to support@ezsoftwarelabs.com with "Arbitration change rejected" in the subject; the version you last agreed to then goes on applying between us.
17.11 Jury trial. IF A CLAIM GOES TO COURT RATHER THAN ARBITRATION, FOR WHATEVER REASON, YOU AND WE EACH WAIVE ANY RIGHT TO A TRIAL BY JURY, TO THE FULLEST EXTENT THE LAW ALLOWS.
17.12 Afterwards. This section continues after your account and these terms end.
18. If you got EZHomePing from the App Store or Google Play
If you got the app from the App Store, your licence to use it is Apple's standard licence agreement for apps, or these terms where the App Store gives them as EZHomePing's licence agreement. Where Apple's agreement applies, it governs that licence, and these terms govern everything else about EZHomePing — section 17 any disagreement about the app included. Either way:
- These terms are between you and EZ Software Labs LLC, not Apple. We, not Apple, are solely responsible for EZHomePing and its content.
- Your licence to the app is not transferable, and lets you use it on Apple-branded products you own or control, as the App Store's usage rules allow — including by other accounts linked to yours through Family Sharing, where those rules allow it.
- We alone provide any maintenance and support for the app, as these terms say or the law requires; Apple has no duty to provide any.
- If the app fails to conform to a warranty that applies, you may tell Apple, and Apple will refund what you paid for the app, if anything. To the fullest extent the law allows, Apple has no other warranty duty for the app, and any other claim, loss, liability, damage, cost or expense from such a failure is ours, as far as these terms do not disclaim it.
- We, not Apple, deal with any claim by you or anyone else about the app or your having or using it — that it is defective; that it fails to meet a legal or regulatory requirement; or under consumer-protection, privacy or similar law.
- If anyone claims that the app, or your having or using it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not in a country under a US embargo, or one the US government has designated as "terrorist supporting", and that you are not on any US list of prohibited or restricted parties.
- Questions, complaints and claims about the app go to EZ Software Labs LLC, at support@ezsoftwarelabs.com.
- You must follow the terms of any other company that apply when you use the app — your wireless carrier's, for example.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right — and is taken to have accepted it — to enforce them against you as a third-party beneficiary.
If you got the app from Google Play, Google Play's terms apply to your purchase. Google is not a party to these terms and is not responsible for EZHomePing.
19. Changes to these terms
We may change these terms. We post every change here, and change the date at the top. A change takes effect when it is posted, except that one that takes away a right you have, or adds to what you must do, takes effect 30 days after it is posted — sooner only where the law requires it, or someone's safety or the security of the service needs it. We may also tell you of a change in the app or by email, but the posting here is the notice. If you go on using EZHomePing after a change takes effect, you accept it; if you do not accept it, stop using EZHomePing and delete your account. Section 17.10 has its own rule for changes to section 17.
20. General
- The whole agreement. These terms, our privacy policy, and any terms shown to you for a feature when you use it, are the whole agreement between you and us about EZHomePing.
- If a part fails. If a court or arbitrator finds part of these terms unenforceable, it is enforced as far as it can be, and the rest still applies; section 17.9 says what happens within section 17.
- No waiver. If we do not enforce part of these terms at once, we can still enforce it later.
- Transfers. You may not transfer these terms or your account to anyone. We may transfer them to a company that takes over EZHomePing or our business — in a merger, an acquisition or a sale — or to a company related to us; our privacy policy says what happens to your information then.
- Things beyond our control. We are not responsible for a delay or failure caused by events beyond our reasonable control: failures of networks, power, cloud or push services or the app stores, attacks, disasters, epidemics, or a government's actions, for example.
- Export and sanctions. You may not use EZHomePing where US export controls or sanctions forbid it, or if you are on a US list of prohibited or restricted parties.
- Notices. We may send you notices by email to your account's address, in the app, or by posting them on our website; you send yours to support@ezsoftwarelabs.com. You agree to receive them electronically, and that they meet any requirement that a notice be in writing.
- Who these terms are for. You and us, and the people section 14 and section 15 name; Apple, as section 18 says; nobody else. Nothing in them makes either of us the other's partner, agent or employee.
- Reading them. Headings are only for finding your way, and "including" means including without limitation.
